Welcome to eSchoolMS. These Terms of Service ("Terms") govern your access to and use of the eSchoolMS website, platform, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms.

1. Eligibility and Account Registration

You must be authorized to act on behalf of your school or organization to register for and use the Services. You agree to provide accurate information during registration and keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2. Scope of Services

eSchoolMS provides school management tools including, but not limited to, student records, report cards, attendance, class and subject management, billing workflows, and communication features. We may update, improve, or modify features from time to time.

3. Acceptable Use

You agree not to misuse the Services. Prohibited activities include:

• Using the Services for unlawful, fraudulent, or unauthorized purposes.
• Attempting to gain unauthorized access to systems, accounts, or data.
• Uploading malicious code, malware, or content that disrupts service operations.
• Infringing intellectual property or privacy rights of any person or entity.
• Using the platform to send abusive, deceptive, or harmful communications.

4. School Data and Responsibilities

Your school is responsible for the legality, accuracy, and integrity of all data entered into the Services, including student, parent, and staff information. You are responsible for obtaining all required consents and legal permissions under applicable laws before collecting, storing, or sharing personal data using the platform.

5. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws. We implement reasonable technical and organizational safeguards, but no system can be guaranteed 100% secure.

6. Fees, Billing, and Subscriptions

Some features require a paid subscription. By purchasing a plan, you agree to the applicable pricing, billing cycle, and payment terms shown at checkout. Subscription fees are generally non-refundable except where required by law or explicitly stated in writing.

7. Third-Party Services

The Services may integrate with or link to third-party providers (for example, payment gateways or communication channels). Your use of third-party services may be subject to their own terms and policies, and we are not responsible for third-party products or services.

8. Intellectual Property

eSchoolMS and its content, software, branding, and materials are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your school's internal operations.

We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, or use the Services in a way that creates legal, security, or operational risk. You may stop using the Services at any time.

10. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee uninterrupted or error-free operation at all times.

11. Limitation of Liability

To the fullest extent permitted by law, eSchoolMS shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising from or related to the use of the Services.

12. Indemnification

You agree to indemnify and hold harmless eSchoolMS, its affiliates, and personnel from any claims, liabilities, damages, and costs arising out of your use of the Services, your data, or your breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Ghana, without regard to conflict of law principles, unless applicable law requires otherwise.
